These Terms and Conditions ("Terms") govern all charter bookings and the use of the ombakstena website. By making an enquiry, confirming a booking, or using our website, you agree to these Terms. Please read them before proceeding.

By confirming a booking or using this website, the Booking Party represents that they are at least 18 years of age and have the legal capacity to enter into a binding agreement. If booking on behalf of a group, the Booking Party accepts these Terms on behalf of all guests in the group.

3. Charter Services

ombakstena offers three charter experiences: the Afternoon Tea Cruise, Night Sky Sailing, and Bespoke Celebration Charter. Each charter is described in detail on our website and in booking communications. All charters depart from HarbourFront unless otherwise agreed for the Bespoke Charter.

We reserve the right to adjust charter routes, timings, or specific elements in response to safety requirements, weather conditions, or circumstances beyond our control, without this constituting a material change to the booked service.

7. Dietary Requirements and Allergies

While we make every effort to accommodate dietary requirements and allergies communicated in advance, we cannot assume liability for allergic reactions where requirements were not disclosed prior to the charter. Guests with severe allergies are responsible for informing us at the time of booking and for taking appropriate precautions on board.

8. Intellectual Property

All content on the ombakstena website — including text, images, and design — is the property of ombakstena and may not be reproduced, distributed, or used commercially without written permission. Nothing in these Terms grants any licence to use our intellectual property.

9. Photography and Media

Photographs or video recordings taken on board by ombakstena staff (including contracted photographers for the Bespoke Charter) may be used for promotional purposes unless the Booking Party expressly opts out in writing before the charter date. Personal photography by guests is permitted and is subject to no restriction from us.

10. Limitation of Liability

ombakstena maintains appropriate insurance for its charter operations. To the fullest extent permitted by Singapore law, our liability for any claim arising from a charter is limited to the amount paid for that specific charter.

We are not liable for loss of personal property, indirect or consequential losses, or losses arising from circumstances beyond our reasonable control, including but not limited to weather, port authority directives, or maritime incidents not attributable to crew negligence.

11. Disclaimers

Charter experiences are provided in good faith on the basis of the information available at the time of booking. We do not warrant that all elements of a charter will be available or uninterrupted (for example, specific star visibility on a Night Sky Sailing cannot be warranted). Our descriptions represent what we aim to deliver, not an absolute commitment to identical outcomes.

12. Indemnification

The Booking Party agrees to indemnify and hold ombakstena harmless from any claims, damages, or costs arising from the conduct of guests in their party, including any breach of these Terms or failure to follow crew instructions.

13. Termination

We reserve the right to terminate a charter in progress if the safety of guests, crew, or the vessel is at risk, or if guests engage in conduct that is dangerous, abusive, or materially inconsistent with these Terms. No refund will be issued in such circumstances.

14. Dispute Resolution

These Terms are governed by the laws of Singapore. In the event of a dispute, the parties agree to first attempt resolution through direct communication. If unresolved, disputes will be subject to the non-exclusive jurisdiction of the courts of Singapore. For minor disputes, mediation through the Singapore Mediation Centre may be proposed by either party before formal legal proceedings.

15. Changes to These Terms

We may update these Terms from time to time. The revised version will be posted on this page with an updated date. Bookings confirmed before the date of any revision remain subject to the Terms in force at the time of confirmation.
